First & Foremost:     (Avoid Attorney's..... Yet, immediately interview a few Attorney's just in case)

  • "Attempt" to keep open communication with your spouse & at the same time Interview the top 3 or 4 Family Law Lawyers

    • Don't Hire or Sign a Contract: Pay their consultation fee for no more than an hour. Interviewing the lawyers should help you decide who best will help with your case in the event you need to obtain legal council (hopefully for both parties and their children, attorney's can be avoided).
    • KEEP IN MIND THAT "TYPICALLY" THE ONLY WINNER IN FAMILY LAW = ATTORNEY who become Judges!
      • STOP & THINK:
        • If you have Little to NO $ or Assets (especially property)... Attorney's will either not take the case, wrap up the case quickly and or push you aside!
        • If you have $$$$$ / Property etc, etc... Some Attorney's will purposely aggravate and inflame the case just to rack up billable hours!
          • Attorney's innocent question of your home and available cash is also used by them to determine how long they keep the fight up and get paid!
          • Attorney's will not hesitate to LIEN your home and then force you to sell it to pay their bill.
          • DON'T FALL INTO THE TRAP! .. IF YOU NEED AN ATTORNEY, FIND A GOOD DECENT ONE .. THAT GETS THE CASE DONE QUICKLY AND AMICABLE.
    • Speak to your Spouse and see if you can handle the case amicably - You both put in writing an agreement to split all assets by 1/2 and if you have children, come up with a simple plan to spend time, holiday's, family events etc, etc, and each sign the agreement.
      • If agreement is not signed immediately and or any hesitation by the other spouse or the other spouse obtains council...
      • DON'T WAIT, your spouse is likely just wanting to fight and you and your children will likely be affected especially if your spouse has an agenda to remove your children from you


If your spouse is wanting 100% Legal and Physical Custody of your children -- Don't Wait:

  • Begin immediate legal process to protect your children from what may become a parental alienation that will likely become more difficult to deal with at a later time!!!

  • Expect Allegations, TRO (Temporary Restraining Orders), Court FORCING you to not be able to see your children, your spouse bad mouthing you to anyone who will lend an ear and those who agree with the poison speaking spouse may be to cowardly and unprofessional to contact you to get your side of what is occurring and you and your family being approached at public events where your spouse demands that you leave!!! DON'T WAIT!!!

Your Spouse is using every tool legal to remove your children away from you!

Children / 730 Evaluation:

If your spouse is using frivolous, selfish, vindictive, or bad faith moves to tear the children away from a loving parent.

a. Immediately Demand a 730 Evaluation:

  • Make sure you interview Doctors who are good at this.
  • Watch OUT if the the Doctor is working on behalf of the opposing side and or the opposing Law Firm uses that Doctor often and or that Doctor is just trying to make a quick buck and does not take the time to properly interview ALL persons who actually know each parent!
    • Before you agree on a Doctor, ask the Dr:
      • "How often have you worked with the other law firm" and if so,
      • "How often has your report been in that Law Firms Favor?"
      • KEEP EYES WIDE OPEN!! Questions like ...
        • Is the Dr. in Favor of Families being together and of the children will likely be answered yes...so these questions are not as helpful as the potential biased towards Dad or Mom, Bias for a particular Lawyer or Law Firm that Pays Their Bill by feeding them more clients when that Lawyers / Law Firm knows the end result will likely be in favor of their client. SHAME ON THESE DR'S, LAWYERS AND LAW FIRMS .. AND JUDGES / COURTS THAT WILLFULLY AND KNOWINGLY ALLOW THESE TACTICS!

b. Deposition Anyone that you feel is important to your case.

  • Anyone who LIES in a deposition may be held in contempt of court and may end up being sued by you for providing false information.

5. TRO (Temporary Restraining Order):

  • If TRO has been filed against you and or you are being threatened to have on filed against you
    • Immediately do a Deposition on the person(s) who are doing this to you !!!
    • Don't Wait!!   A deposition is sworn testimony taken in a case wherein the witness, or deponent, is placed under oath by an officer, ordinarily a notary public, and the witness then answers questions put by both sides of the case. The deposition is normally done pre-trial and in one of the attorney's offices.
      • If they are lying, immediately file a Civil Case against the person and request that the Judge impose jail time for perjury in court / court document.
